No data protection officer has been appointed because this is not mandatory for the activities we carry out.
2. Data we process and where it comes from
We process information you provide directly when you contact us through the form, email, telephone or WhatsApp:
- Your name, telephone number and contact details.
- The address, municipality and location of the requested work.
- A description of the installation, fault or service.
- Photographs you choose to attach and any technical or personal information visible in them.
- Communications needed to arrange a visit, prepare a quotation or provide the service.
We do not request special-category data. Please do not send medical information, identity documents, bank details or images of people unless they are strictly necessary to assess the work.
3. Purposes and legal bases
Enquiries and preparation of services
We use your data to respond, assess the work, arrange a visit and prepare a quotation. The legal basis is taking pre-contractual steps at your request and, where relevant, performance of a contract (Article 6(1)(b) GDPR).
Optional photographs
Photographs are used only to understand the installation or fault and prepare our response. By attaching them voluntarily, you consent to this processing (Article 6(1)(a) GDPR). You may withdraw consent without affecting earlier processing.
Legal obligations and security
When work is commissioned, some data is processed to meet tax, accounting, warranty and safety obligations (Article 6(1)(c) GDPR). Proportionate fraud, spam and misuse prevention measures may also be applied on the basis of our legitimate interests (Article 6(1)(f) GDPR).
We will not use your details for advertising or marketing without first obtaining separate consent.
4. Retention
- Enquiries that do not result in a contract are kept only as long as needed and for no more than twelve months after they are closed.
- Where a service is commissioned, data is kept throughout the relationship and for the periods required by tax, accounting, commercial, warranty and liability rules.
- Photographs are deleted when no longer needed to assess or carry out the work, unless they must be retained to document a warranty, incident or claim.
5. Recipients and service providers
We do not sell your data or disclose it for commercial purposes. Necessary hosting, email, security, administrative and communications providers may process it under their contractual and legal duties. Data may also be disclosed to public bodies, insurers, advisers or authorities where legally required or where needed to bring or defend a claim.
Temporary form service
The current form uses FormSubmit to deliver the enquiry to our email account. Its documentation states that submissions are archived for thirty days and uploaded files are not available through its API. You can read FormSubmit's privacy information. If you prefer not to use this provider, contact us directly by telephone or email.
If you contact us through WhatsApp, your data will also be processed by WhatsApp Ireland Limited and the relevant entities under their own privacy policy. This channel is optional; telephone and email are available as alternatives.
6. International transfers
Electra Sigma does not initiate international transfers for its own purposes. Some technology providers, including WhatsApp and the temporary form service, may process information outside the European Economic Area. In such cases, processing is subject to the safeguards and mechanisms identified by the provider, such as adequacy decisions or standard contractual clauses where applicable.
You can avoid using these services by contacting us by telephone or directly by email.
7. Your rights
You may request access, correction, erasure, restriction, objection and portability, and may withdraw consent at any time. Email hello@electrasigma.es and tell us which right you wish to exercise. We will request additional information only where needed to verify your identity.
If you believe the processing does not comply with the law, you may lodge a complaint with the Spanish Data Protection Agency.
8. Security and confidentiality
We apply technical and organisational measures appropriate to the type of information processed to prevent unauthorised access, loss, alteration or disclosure. Access is limited to people who need the data to handle the enquiry or provide the service.
No system is completely infallible. If you become aware of an incorrect submission or a data-related incident, please contact us promptly.
9. Third-party and children's data
If you provide another person's data or photograph, you confirm that you are authorised to do so and that the information is relevant to the enquiry. The website and services are not specifically directed at children under fourteen.
10. Cookies and language preference
This version of the website does not use analytics, advertising or tracking cookies. Your browser stores the ES/EN preference locally to remember the selected language; this stays on your device and does not identify you.
11. Changes to this policy
We may update this policy when services, providers or legal requirements change. The current version will always be available on this page with its latest revision date.
